The presidential system is many democracies is flawed, and even the US has it share of problems. Taiwan’s woes are serious but impeachment is not an option. South Korea's constitution should be changed to implement a modified semi-presidential system, and the presidency should be declared to be above party politics. The heads of the judicial and procuratorial branches should be elected in alternating years, and 1/4 of all MPs should face election each year. In 2015, the conviction rate in criminal trials in mainland China was 99.92 per cent, with 1.23 million accused being convicted. High conviction rates were seen as vindicating the way the authorities handled cases.
The world is constantly changing and problems arise endlessly. Judicial reform is only a part of the solution. China's problem is that it needs full constitutional reform to institute election of the heads of the judicial and procuratorial branches; judicial policies, operations, personnel and budgets need to be reviewed every 5 years and publicly reviewed to keep pace with the times. I refer to the letter by Winnie Chui, for the secretary for security (“Permit scheme allows mainland residents to reunite with families in Hong Kong”) .
Article 39 of the Hong Kong Basic Law states that the right to self-determination is specified in the two international human rights conventions. The people of Hong Kong cannot take this right for granted. In Switzerland the threshold for petitioning for a referendum is 50,000 signatures, and with that citizens can express their opinion by voting rather than taking to the streets. The people have the right to hold referendums on any public issues. For more, see the Charter for Permanent Peace and Development / Global Unity Constitutional Standards.
A judge in Argentina has ruled that former president Cristina Fernandez de Kirchner should stand trial on charges of financial mismanagement.
Power leads to corruption, and absolute power leads to absolute corruption. Argentina’s constitutional mechanism is dysfunctional and comprehensive constitutional reform is desperately needed. Changes should include electing the heads of the executive, legislative, judicial and procuratorial branches in alternating years and having 1/4 of all MPs face election each year. The South Korean ferry disaster shows the needs for the principle of One World under One Set of Laws and working toward a common destiny for humankind. It should prompt the South Korean government to recognize that international law is higher than domestic law and should have direct bearing on the people and human rights. South Korea needs to improve its human rights standards to the levels of the highest international standards. See the Charter for Permanent Peace and Development.
